Georgia Theft Crimes

Theft is generally charged based on the value of the property or services involved. As an example, theft of property valued at $500 or less is considered a misdemeanor punishable by up to a year in jail and a fine of up to $1,000. Theft of property or services valued above $500 is generally charged as a felony. Georgia law defines theft in many different ways.

These include theft through:

  • Deception
  • Conversion
  • Shoplifting
  • Extortion
  • Receiving or bringing into the state stolen property
  • Theft of services
  • Taking lost property

Felony Theft in Georgia

Felony theft also includes such activities as vehicle theft, theft conducted online, theft by someone in a fiduciary position, and theft of government or bank property by a government or bank employee. Felony theft carries penalties of one to 15 years in prison along with steeper fines.

Shoplifting is its own theft offense. It is charged as a misdemeanor when the value of the property stolen is $300 or less. When the stolen property is valued at more than $300, shoplifting becomes a felony. Second shoplifting offenses can carry a fine of up to $250 along with a potential jail sentence. Third and fourth convictions carry harsher penalties.

Besides a criminal conviction, you may also face a civil lawsuit brought against you by the theft victims which may involve monetary damages for the property taken as well as for any other losses
